Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you and DevX ("we," "us," or "our"), concerning your access to and use of our platform. You agree that by accessing the platform, you have read, understood, and agreed to be bound by all of these Terms of Service.

IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF SERVICE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE PLATFORM AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Intellectual Property Rights

Unless otherwise indicated, the platform is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the platform (collectively, the "Content") are owned or controlled by us or licensed to us.

User Representations

By using the platform, you represent and warrant that:

• You will not access the platform through automated or non-human means
• You will not use the platform for any illegal or unauthorized purpose
• Your use of the platform will not violate any applicable law or regulation

User Registration

You may be required to register with the platform. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

• Upload or transmit viruses, malware, or any other type of malicious code
• Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the platform to you

User Generated Contributions

The platform may invite you to submit tools, resources, or other content. Any content you submit may be made publicly available and may be used by us in accordance with our Privacy Policy.

By submitting contributions, you grant us a perpetual, non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such contributions in connection with the operation of the platform.

Third-Party Websites and Content

The platform may contain links to third-party websites and services, including but not limited to GitHub and YouTube. We do not control, endorse, or assume responsibility for any such third-party sites, information, materials, products, or services.

If you access a third-party website from the platform, you do so at your own risk and you understand that these Terms of Service do not apply to your use of such sites.

Platform Management

We reserve the right, but not the obligation, to:

• Monitor the platform for violations of these Terms of Service
• Take appropriate legal action against anyone who violates these Terms of Service
• Remove from the platform any content that we determine is inappropriate or violates these Terms of Service
• Terminate or suspend your access to all or part of the platform for any or no reason

THE PLATFORM IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE PLATFORM AND OUR SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE PLATFORM.

WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE PLATFORM'S CONTENT OR THE CONTENT OF ANY WEBSITES LINKED TO THE PLATFORM.

Limitations of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA ARISING FROM YOUR USE OF THE PLATFORM.

Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the platform at any time or for any reason at our sole discretion without notice. We also reserve the right to modify or discontinue all or part of the platform without notice at any time.

Governing Law

These Terms of Service and your use of the platform are governed by and construed in accordance with the laws applicable to agreements made and to be entirely performed within the jurisdiction in which we operate.
